1. General Agreement
These Terms and Conditions ("Terms") govern your use of the website and services provided by Sarojit Pal Art ("Artist," "We," "Us"). By accessing our website, purchasing courses, or commissioning artwork, you agree to be bound by these Terms.
2. Course Enrollment & Access
- **Course Access:** Access to purchased digital courses (video lessons, resources, etc.) is typically granted immediately and is **non-transferable**.
- **License:** When you purchase a course, you are granted a non-exclusive, non-sublicensable license to use the content for your personal, non-commercial education only.
- **Prohibited Use:** You may **not** share, re-sell, distribute, or publicly display any course content, including videos, PDFs, or homework materials.
- **Refunds (Digital Courses):** Due to the digital nature of the content and immediate access, all sales of digital courses are **final** and **non-refundable**. Exceptions may be considered only if no content has been accessed, at the sole discretion of the Artist.
3. Art Commission & Work-for-Hire
- **Initial Deposit:** All commissions require a **50% non-refundable deposit** before any work begins. This covers initial research, planning, and concept sketches.
- **Pricing and Scope:** Pricing is based on complexity, size, and usage rights defined in the initial agreement (the "Scope"). Any changes to the Scope after the deposit is paid may result in an additional fee and timeline adjustment.
- **Revisions:** Commissions include a set number of minor revisions (e.g., 2 rounds) at the sketch/concept stage. Substantial changes requested after the final line-art or coloring stage will incur **hourly fees**.
- **Payment of Final Balance:** The remaining 50% balance, plus any additional fees, must be paid upon completion and before the final digital files or physical artwork is delivered.
- **Intellectual Property (IP):**
- **The Artist retains all copyrights** to the artwork, including the right to display the work in their portfolio, social media, and use it for self-promotional purposes.
- The Client receives the agreed-upon **usage rights** (e.g., personal use, commercial printing). If the Client requires a full IP transfer (Work-for-Hire), this must be negotiated and included in the price, granting them all copyrights.
4. Limitation of Liability
The Artist is not responsible for any damage, loss, or injury resulting from the use of our services or products. Our total liability is limited to the amount paid by you for the specific course or artwork.
